The Letter
A CGA expert opinion letter is an independent, third-party assessment confirming that a creator meets the USCIS standard for extraordinary ability. It is issued on CGA letterhead and signed by a CGA President or Director, carrying the institutional authority of a recognized industry body rather than a personal reference. It is written to map the creator's record to the USCIS O-1 and EB-1 evidentiary criteria, and it serves as supporting evidence for the petition your attorney prepares. CGA does not provide legal representation or file petitions. Final decisions are made by USCIS.
Who Qualifies
Creators with a measurable, recognized career in the creator economy. This includes YouTubers, TikTok and Instagram creators, podcasters, filmmakers, photographers, writers, digital artists, fashion creators, esports talent, and founders building in the creator space. Evaluation is anchored to CGA's published eligibility standard and to how USCIS weighs extraordinary ability. Members and non-members both qualify to apply.
What to Submit
Strong letters come from strong evidence. The more verifiable and third-party the evidence, the stronger the letter.
Required materials:
Completed intake form
The creator's primary public profile or website
The creator's full legal name as shown on their passport, plus a copy of the passport photo page
Three strongest pieces of evidence (press, socials, portfolio, contracts, etc.)
Evidence that carries weight, in rough order of strength:
Named press: features, interviews, or rankings in established outlets, not self-published posts
Verified reach: follower, subscriber, and view counts on major platforms, with analytics exports or screenshots
Commercial impact: brand partnership contracts or invoices showing dollar values, ad or subscription revenue, product or business revenue
Awards and recognition: industry or platform awards, nominations, festival selections
Leadership and influence: speaking engagements, judging or panel roles, teaching, founding roles, original formats or contributions to the field
Evidence that only shows the creator's own posts, with no outside source to confirm it, carries little weight. An adjudicator weighs what a third party can verify.
How we Evaluate
CGA reviews the full record against the USCIS O-1 and EB-1 criteria: sustained national or international recognition, leading or critical roles, commercial and critical success, recognition from established sources, and original contributions to the field. The framework covers audience reach, monetization history, press, brand partnerships, awards, speaking, and professional leadership. CGA reviews only complete submissions and may decline to issue a letter when the record does not meet the standard.
Processing Time
Letters are issued within 14 business days of a complete submission. Complex records may take longer. Rush processing is available for time-sensitive filings for an additional $250.00. During checkout during Step 1, you can add 48 hour rush processing. If you have not heard from us after 14 business days, contact letters@creatorsguildofamerica.org.
Costs
Non-members: $600. CGA members: $300. Please note that to become a member, there is a mandatory 7 day processing period. Both receive the same evaluation and a professionally authored letter. Payment is submitted before review begins.
Frequently asked questions:
1. What is an O-1 visa for creators and influencers?
The O-1 visa is a US work visa for individuals with extraordinary ability in fields such as digital media, entertainment, content creation, film, television, fashion, and emerging media. Creators qualify by demonstrating sustained national or international recognition, professional credits, press, awards, and industry impact.
2. What is an EB-1 visa and how is it different from an O-1?
The EB-1 is a permanent residency green card category for individuals with extraordinary ability. Unlike the O-1, the EB-1 does not require employer sponsorship and has a higher evidentiary standard. Many creators first obtain an O-1 visa and later transition to an EB-1.
3. What are letters of extraordinary ability or expert opinion letters?
Letters of extraordinary ability are expert statements written by recognized industry authorities confirming that a creator meets USCIS standards for distinction, recognition, and professional standing. These letters are a critical component of O-1 and EB-1 visa petitions.
4. Who provides these letters through the Creators Guild of America?
The Creators Guild of America provides independent expert opinion letters issued by industry-recognized professionals, executives, and advisors with verifiable authority in media, entertainment, technology, and the creator economy.
5. Are CGA letters accepted by the USCIS and immigration attorneys?

6. What types of creators qualify for O-1 and EB-1 support?
Eligible creators include influencers, YouTubers, filmmakers, photographers, writers, producers, digital artists, fashion creators, podcasters, esports talent, and founders whose work demonstrates professional recognition, distribution, monetization, and cultural or commercial impact.
7. Does the CGA replace an immigration attorney?
No. CGA does not provide legal representation or file petitions. We support creators and attorneys by supplying independent expert opinion letters and industry documentation that strengthen visa applications.
8. How does the CGA evaluate extraordinary ability?
We review professional credits, audience reach, brand partnerships, press coverage, revenue history, leadership roles, awards, speaking engagements, and measurable industry influence. Evaluations align with USCIS O-1 and EB-1 criteria.
9. How long does it take to receive an expert opinion letter?
Most letters are issued within a defined review window once documentation is complete. Timing depends on complexity, field of work, and verification requirements. Our current demand requires up to 14 days, but we also offer a rush processing option.
